Trade Samples and Internal Product Samples Guidance

Under the Administrative Rules, certain marijuana businesses are authorized to provide trade samples to other businesses and internal product samples to their employees. However, whenever a trade sample is given to an employee of a marijuana business, it is considered an internal product sample and is subject to the internal product sample limits. Both marijuana growers and marijuana processors may provide trade samples to marijuana processors or marijuana sales locations (retailers and provisioning centers). The trade sample limits the transfer to a single processor or marijuana sales location and to no more than 2.5 ounces or marijuana and no more than 15 grams of marijuana concentrate every 30 days.
Growers, processors, marijuana sales locations, and marijuana microbusinesses may transfer internal product samples to their employees for the purpose of ensuring product quality and deciding whether to sell the marijuana product. Internal product samples transfers are limited to 1 ounce of marijuana, 6 grams of concentrate, and marijuana infused products with a total THC content of 2000 mgs per employee every 30 days for processors, sales locations, and microbusinesses and 1 ounce of marijuana every 30 days per employee for growers.
