The Cannabis Regulatory Agency (CRA) released a new bulletin revising the maximum per container THC limit on adult-use marijuana edible products and providing new guidance relating to marijuana tinctures. Tinctures recently became an enforcement issue when the CRA determined that the definition of a “tincture” only included alcohol-based products, despite the industry standard of producing oil-based products that were sold as tinctures.
Under the new guidance, both tinctures and “oil-based drops,” are placed in a single category with a 10 mg per dose and 200 mg per container maximum THC limit for adult use products and a 100 mg per dose and 2000 mg per container limit for medical products. These products must be in containers that allow for measured doses or servings and cannot contain any sugar or natural or synthetic sweeteners.
The Cannabis Regulatory Agency has also revised the maximum per container THC limits for all adult-use infused edibles to 200 mg per container. This will allow licensees who were previously producing and selling 200 mg container packages of sweetened products as “tinctures” to now make and sell those products as drink enhancers or syrups with the same upper THC limit.
